Terms of Service

In case of inconsistency between language versions, the German version prevails.

1. Provider

These Terms of Service ("Terms") govern your use of the website finifun.app and the digital content "finifun Premium", offered by:

2. Acceptance

By using finifun you agree to these Terms. If you do not agree, please do not use the service.

3. Description of the service

finifun is a small browser tool for drawing mandalas and calm shapes. A free basic version is available without an account. Optionally, "finifun Premium" can be unlocked once, adding extra shapes, brush sizes, palettes, and a gallery.

4. Sale and payment — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, cancellation, and refunds are governed by the Paddle Buyer Terms and our refund and withdrawal policy.

5. Intellectual property

The finifun software, design, and all content are protected by copyright and owned by PESCHE DESIGN. With your Premium purchase you receive a limited, non-transferable, non-exclusive licence to use the unlocked content for personal use.

6. Prohibited use

You agree not to misuse finifun. In particular, you must not:

  • use the service unlawfully or infringe the rights of others,
  • engage in fraud, spam, or automated mass scraping,
  • distribute malware or probe the security of the service,
  • reverse engineer, decompile, or circumvent technical protection measures,
  • resell, redistribute, or commercially sublicense the content.

7. Availability / service level

We aim for stable operation but do not guarantee uninterrupted or error-free availability. Maintenance, security incidents, or third-party outages may cause temporary interruptions.

8. Warranty disclaimer

To the fullest extent permitted by law, we disclaim all implied warranties (in particular merchantability and fitness for a particular purpose). Mandatory consumer rights remain unaffected.

9. Liability

Our liability is limited to intent and gross negligence. For ordinary negligence we are only liable for the breach of essential contractual duties and only up to the foreseeable, contract-typical damage. Liability for injury to life, body, or health and under the German Product Liability Act remains unaffected.

10. Suspension and termination

We may suspend or terminate access to finifun without notice in case of material breach, non-payment, security or fraud risk, or repeated violations of these Terms. On termination, your rights to already purchased and non-refunded Premium content remain to the extent provided by law.

11. Changes

We may update these Terms if legal or technical conditions change. The current version is always available on this page.

12. Governing law and venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the consumer's country of residence remain unaffected. Place of jurisdiction for merchants is, where permitted, Offenburg, Germany.
